Terms & Conditions

These Terms & Conditions form an agreement between you and Prabhkirat Singh Saini, sole trader, ABN 65 967 758 455 (the Seller). Tap2Rate identifies the Tap2Rate Square and Tap2Rate Stand product range only; it is not a separate business or legal entity.

Checkout acceptance

By proceeding from checkout, you agree to these Terms & Conditions and confirm you are authorised to order for the business named in the order. Your acceptance is recorded with the order draft, including the policy version and time of acceptance.

Order acceptance

A checkout submission records an order draft only. The Seller may accept, reject, cancel or pause an order before configuration if details are incomplete, payment cannot be confirmed, the business profile cannot be matched, the intended use appears unlawful, delivery is impractical, or these terms are breached.

Fixed products and business-specific configuration

The current Tap2Rate Square and Tap2Rate Stand use the fixed white product design shown on the website. The Seller locates the public Google Business Profile associated with the business details in the order, confirms the match with you when necessary, configures the NFC and QR destinations, and tests both before delivery. No custom artwork, logo upload or separate artwork proof is included in this range.

Customer authority and supplied details

You are responsible for the accuracy and completeness of the business, contact and delivery details you provide; your authority to order for the named business; your compliance with review-platform rules; and how the product is used. The Seller takes reasonable steps to match the public profile but may rely on your confirmation where businesses have similar names. The Seller is not responsible for incorrect customer confirmations or review outcomes outside the Seller's control, except to the extent Australian Consumer Law requires otherwise.

Genuine review use

Tap2Rate products must be used only for genuine customer review requests. You must not use a Tap2Rate product for fake reviews, employee reviews presented as customer reviews, review gating, selective suppression of negative feedback, pressure, threats, review swaps, undisclosed incentives, paid endorsements without disclosure, competitor attacks or platform-rule breaches.

No review outcome guarantee

The Seller supplies physical Tap2Rate review prompt products. Neither the Seller nor a Tap2Rate product guarantees any number of reviews, star rating, ranking, search result, customer response, Google Business Profile outcome or third-party platform decision.

Third-party platforms

Google, Google Business Profile, payment providers, hosting providers, maps tools and other third parties are outside the Seller's control. Neither the Seller nor the Tap2Rate products are affiliated with or endorsed by Google. The Seller is not responsible for third-party outages, account restrictions, policy changes, link changes, moderation decisions or rejected reviews.

Payment and pricing

Prices are shown in Australian dollars. Payment must be confirmed before profile verification, configuration and delivery preparation unless the Seller agrees otherwise in writing. The Seller is not presently represented on this website as registered for GST, so receipts must not be described as tax invoices unless that status and the website's tax wording are updated.

Privacy and personal information

The Seller may collect and use the contact, business, delivery, order, profile-match, configuration, payment-handoff and support details needed to respond to enquiries, configure products, process orders, arrange payment or delivery, keep business records, prevent misuse and provide support. The Seller does not sell personal information and may share only what is needed with service providers such as payment, email, delivery, hosting, analytics or notification tools. Returns and Australian Consumer Law

Because each product is configured for a specific business, change-of-mind cancellations may be refused after profile verification, programming or delivery preparation begins. If a product is damaged, faulty, unsafe or materially different from the accepted order details, the Seller will resolve it in line with Australian Consumer Law. Nothing in these terms excludes, restricts or modifies consumer guarantees or other rights that cannot be excluded by law.

Delivery

A flat $9.95 delivery fee applies to each order Australia-wide. The Seller configures and tests the NFC tap plus QR scan before dispatch. You are responsible for giving correct address details and a contact person who can receive the order. Incorrect details or failed delivery may delay dispatch or require a redelivery charge.

Goodwill exceptions

The Seller may choose to make a goodwill exception in a specific case. A goodwill exception does not change these terms, create an ongoing obligation, or waive the Seller's rights for any other order unless the Seller agrees in writing.

Liability limit

Nothing in these terms excludes non-excludable rights under Australian Consumer Law. To the maximum extent allowed by law, the Seller is not liable for indirect loss, lost revenue, lost reputation, lost reviews, platform penalties, customer disputes, business interruption, or losses caused by incorrect customer details or confirmations, third-party platforms, customer misuse or unauthorised business orders. Where liability can lawfully be limited, the Seller may limit liability to resupplying the service, repairing or replacing goods, or refunding the amount paid for the affected order.

Indemnity for misuse

You agree to protect the Seller from claims, losses, costs, expenses and third-party demands arising from information or confirmations you supply, your misuse of a product, unauthorised business orders, unlawful review requests, misleading customer conduct, platform-rule breaches, or breach of these terms, except to the extent caused by the Seller's own unlawful conduct.

Policy changes

The Seller may update these policies from time to time. The policy version accepted at checkout applies to that order unless a later change is required by law or agreed in writing.

Governing law

These terms are governed by the laws of Victoria, Australia. If any part is invalid or unenforceable, the remaining parts continue to apply to the maximum extent allowed by law.
